Terms of Service

1. Eligibility

You must be at least 18 years old to use Stance. By using the App, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3. Description of Service

Stance is a real-time voice debate platform that allows users to:

• Engage in structured voice debates on various topics
• Have debates evaluated by artificial intelligence
• Vote on debate outcomes
• View and listen to promoted debate recordings

4. User Conduct

You agree not to use the App to:

4.1 Prohibited Content

• Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Engage in hate speech, discrimination, or harassment based on protected characteristics
• Share content that exploits or endangers minors
• Distribute spam, malware, or other harmful code
• Infringe on intellectual property rights of others

4.2 Prohibited Behavior

• Impersonate any person or entity
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any portion of the App
• Use the App for any illegal purpose
• Harass, bully, or intimidate other users
• Manipulate debate outcomes or voting through fraudulent means
• Create multiple accounts to circumvent bans or restrictions

4.3 Debate Conduct

• Engage in good faith debate on the assigned topic
• Respect your opponent and maintain civil discourse
• Not intentionally forfeit or abandon debates to manipulate rankings
• Not collude with opponents to manipulate outcomes

5. Content Ownership and License

Your Content: You retain ownership of content you create through the App, including your voice recordings. By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content for operating and improving the App.

Promoted Debates: If your debate is "promoted" (featured publicly), you grant us additional rights to display, distribute, and promote that recording.

Our Content: The App and its original content, features, and functionality are owned by us and protected by intellectual property laws.

6. AI Evaluation

Debates on Stance may be evaluated by artificial intelligence systems. You acknowledge that AI evaluations are provided for entertainment and informational purposes only, may not be perfectly accurate, do not constitute professional advice, and we are not responsible for any decisions you make based on AI evaluations.

7. Voting and Rankings

The App includes community voting features. Vote counts and rankings are for entertainment purposes. We reserve the right to remove fraudulent votes and modify ranking algorithms at any time.

8. Moderation and Enforcement

We reserve the right to:

• Monitor debates and user content for violations
• Remove or disable access to violating content
• Warn, suspend, or permanently ban violating users
• Report illegal activity to law enforcement

Moderation decisions are made at our sole discretion and are final.

9. Third-Party Services

The App integrates with third-party services including:

• Firebase (Google) for authentication, data storage, and analytics
• Agora for real-time voice communication
• Anthropic for AI-powered debate evaluation

Your use of these services is subject to their respective terms.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stance and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the App, violation of these Terms, or violation of any rights of another party.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms shall be resolved through informal resolution first, then binding arbitration. You agree to resolve disputes individually and waive any right to participate in class actions.
